Notice Period - Boon or a Bane?

Raghav decided to quit their company because they recently came across a better opportunity in the industry which appealed to them. To their surprise, the company changed its notice period policy recently because of the trend the bigger companies started. The change in the notice period policy requires a three-month notice instead of one. The policy assists companies to look for a suitable and efficient employees at their own pace however employees like Raghav who have an opportunity at hand suffer. Raghav is in flux, have you been in a similar situation?

3 Month vs 1 Month Notice Period - Boon or a Bane?

While such a policy might act as the airbag that saves an employee from termination and gives them time to look for opportunities to fall back on. But what we need to understand is the termination of employees unless mandatory cutoffs are less likely to happen especially when compared to employees wanting to voluntarily quit to pursue something else or a better opportunity. So who does this law protects?

In a survey conducted by Hush of employees of the IT sector, it was discovered that even employees believed that the 3 month notice period policy aimed at protecting and securing the functions of the company more than the employees that were bound by it. The need for such a policy is only to tone down the organization's incapability to find suitable employees with the required skills sooner.

Escape from this binding policy.

Even though there are exemptions from the policy which don't require the employee to stick around for three months entirely but they include intense reasons like medical emergencies, marriage, or any other crisis. While these reasons are often acceptable, any other reasons other than them are not especially the ones involving opportunities for career growth for the employee. While an employee can always negotiate to get it shortened it doesn't really work if the organization is unwilling to do so and any hostile behavior from the employee in such cases is only bound to affect their recommendation and references.

While the recruitment industry understands the notice period policy they provide candidates plenty of time to join however it's likely limited for notice periods of one month only. But HRs and recruiters don't have enough flexibility and agency to go about extending their offer till 3 months. So what should an employee do? What options does Raghav have if the reason for them to quit is career growth?

The value of an employee

While companies should always consider helping their employees to get a better opportunity and support their career development, it is a notion too utopian to expect from a business industry that rests on the foundations of capitalism and profit-making. The onus in such cases is on the candidate. Employees being the most precious asset of the company are simply irreplaceable and the absence of good employees before beforehand preparations is bound to have a drastic impact on the operations of the company. In such cases, the company that desires to hire the employee working in another company before the notice period comes to an end offers the candidate's existing organization a buyout.

The buyout acts as a redressal and is either equivalent or more than the damage that might happen in case of the early absence of the employee. However, the buyout is entirely dependant on the candidate's past, experience and skills. If the employee is considered to be an asset that is bound to affect a company's operations and bring profit then the hiring company won't hesitate to offer a good buyout making things easier for the employee.

Well if you are in a position like Raghav's then you just need to be remarkable at your job, efficient, and prove to be an asset. This is why when you are doing the job you need to give it your absolute best because you can never be too sure about the prospects it might bring or affect in your future.
